Terms of Use
The short version
- Enjoy Fishburg for your own personal fun. Please don't hack, copy or resell it.
- Coins, gems and in-game items are part of the game. They have no real-world money value.
- Your progress is saved on your device, and a backup copy is kept on our server with the anonymous account the game creates, so it can come back after a reinstall or on a new device set up from a backup or transfer. Remove Ads is restored through Apple or Google Play. Deleting the social account deletes the backup copy too.
- In Friends we have zero tolerance for objectionable names and abusive behaviour. You can report and block players, and accounts that break the rules are removed.
- Turkish law applies, but nothing here takes away the consumer rights you have by law where you live.
1. Agreement
These terms apply between you and BEYDANUR DONMEZ (Beydanur Dönmez) ("we", "us") when you download or play Fishburg (listed on the App Store and on Google Play as "Fishburg: Aquarium"). If you got Fishburg from the App Store, they apply together with Apple's Licensed Application End User License Agreement, which covers all apps from the App Store. If you got it from Google Play, the Google Play Terms of Service also apply. If you don't agree, please don't use the game. Our Privacy Policy explains how data is handled.
2. Your license
We give you a personal, non-exclusive, non-transferable and revocable license to use Fishburg on devices you own or control (Apple devices for the App Store version, Android devices for the Google Play version), for your own non-commercial entertainment. We (and our licensors) keep all rights in the game, including its art, sounds, code and name.
3. Coins, gems and virtual items
- Coins are earned by playing (for example, by selling fish, cleaning the glass, levelling up and finishing daily tasks) and can also be bought with real money in coin packs. Gems are earned in the game (for example, from awards, the Reward Chest, the login calendar and optional reward videos) or bought with real money. Gems cannot be exchanged for coins.
- Virtual currency and items are a license to use content in the game. They are not property, have no real-world monetary value and cannot be exchanged for money, sold, or transferred to another person or game.
- Coins and gems you buy do not expire.
- We may adjust prices, rewards and game balance in updates. We won't take away items you already own, except to fix a clear error (for example, a bug that granted items by mistake).
4. In-app purchases
| Purchase | What you get | Type | Restorable? | Product ID |
|---|---|---|---|---|
| Gem packs | 50, 120, 300 or 700 gems | Consumable, can be bought again | No | app.fishburg.game.gems50, .gems120, .gems300, .gems700 |
| Coin packs | 18,000, 41,000, 110,000, 500,000 or 1,000,000 coins | Consumable, can be bought again | No | app.fishburg.game.coins5000, .coins12000, .coins30000, .coins70000, .coins1000000 |
| Starter Pack | 30 gems + 50,000 coins, once per game save | One-time consumable | No | app.fishburg.game.starter |
| Remove Ads | Removes the occasional full-screen ads for good | Non-consumable | Yes | app.fishburg.game.removeads |
- All purchases are processed by Apple (App Store) or Google (Google Play Billing). The in-game Store shows the packs that are currently on sale, the amount each one gives and its price in your local currency. Each pack gives the same amount to every player. The numbers in the first four coin pack product IDs are only names; the amounts are the ones in the table. Purchases are non-refundable except where the law requires otherwise or Apple or Google grants a refund. You can ask Apple for a refund or ask Google Play for a refund.
- Remove Ads can be restored on a new device with Settings → General → Restore Purchases using the same Apple Account (on Android, the same Google Account). Purchases do not move between the App Store and Google Play. Gems, coins, the Starter Pack contents and items you have received are stored in your save. Restore Purchases cannot bring them back; they come back only with your save, from a device backup or from the backup copy of your game on our server (see the Privacy Policy). If both are lost (for example, on a new device set up without a backup or transfer, or after you deleted the social account and the app), they cannot be restored.
- Remove Ads removes only the automatic full-screen ads. It does not remove rewarded ads, because those are only shown when you choose to watch one, and they stay available for their rewards.
- There are no random loot boxes. The Reward Chest always shows what's inside.
5. Ads and rewards
Rewarded ads are always optional. A reward is given only after the ad finishes, and some rewards have a daily limit. If no ad is available, no reward is given, and the non-ad option stays available.
6. Game Center
If you use Game Center (iPhone and iPad only), Apple's terms also apply to it. Leaderboard positions, achievements and the in-game Awards are for fun and carry no prize.
7. Friends and player conduct
Friends is a part of the game where you add other players with a player ID, look at their tanks, leave a like and clean their glass. The game creates an anonymous social account for it, with a player ID and a generated display name, when it first starts. You join Friends by accepting its rules in the game. From then on your display name, player ID and level can be seen by anyone who enters your player ID, and a copy of your tanks can be seen by the friends you accept. The Privacy Policy lists exactly what is stored.
We have zero tolerance for objectionable content and abusive users. When you use Friends, you agree that you will not:
- use a display name that is offensive, hateful, sexual, violent, threatening or otherwise objectionable, or that contains someone's personal details or pretends to be another person, us, Apple or Google;
- harass, bully or threaten other players, including through repeated friend requests or through false reports;
- try to get around the name filter, a block or the removal of an account;
- use scripts, bots or modified versions of the app with Friends, or interfere with the server.
- Name filter. Display names are checked by a filter for offensive words. A name that passes the filter can still break these rules.
- Report and block. From inside the game you can report a player whose player ID you have (a friend, or someone who sent you a friend request) and block players. A blocked player sees nothing of yours. You can also write to fishburg.sandbox@outlook.com with the player ID of the player you want to report.
- What we do. We review every report. We remove objectionable names and delete the social accounts of players who break these rules, and we aim to act within 24 hours of a report. We can do this without warning. A removed account loses its friends list, likes and other friends data, and the backup copy of its game. Your game on your device and your purchases are not affected.
- Leaving. You can delete your social account at any time with Settings → About → Delete social account. The game on your device stays as it is, but the backup copy of your game is deleted with the account, so the game can then no longer be brought back after a reinstall or on a new device.
- Cleaning a friend's glass. When a friend cleans your glass, the glass in your own game becomes clean too. The friend gets a small coin reward (once per friend per day, for at most ten cleanings a day). You get no coins for glass that a friend cleaned.
- No value. Likes, friends and anything else in Friends have no real-world value and cannot be exchanged for money.
The server applies daily limits, for example on friend requests, likes, glass cleanings, reports and name changes, and a limit on how many new accounts can be created from one internet address in an hour. Friends needs an internet connection and our server. It may be unavailable at times, and we may change it or close it. The rest of the game does not depend on it.
8. Fair play
Please don't:
- copy, modify, decompile or reverse-engineer the app, except where the law allows it;
- use cheats, hacks or tools that change the game, its purchases, its ads or leaderboard scores;
- interfere with ads or purchases, or try to get paid items without paying;
- use the game for anything illegal or commercial.
Changing your device clock won't speed up the game, and trying to exploit it may cause lost progress. We may ask Apple to remove Game Center leaderboard scores that were obtained by cheating.
9. Changes and availability
We may update, change or stop offering Fishburg or parts of it. Because the game runs on your device, the version you have keeps working offline, except for Friends and the backup copy of your game, which need our server. If we ever remove paid content, we will act fairly and in line with the law and the rules of Apple and Google.
10. Disclaimer
We work hard to make Fishburg fun and reliable, but we provide it "as is" and cannot promise it will be free of bugs or always available. The backup copy of your game on our server helps against lost progress, but we cannot promise that it is always available or up to date. To the extent the law allows, we are not liable for indirect or consequential losses, or for lost game progress. Nothing in these terms limits liability that cannot be limited by law, or the mandatory consumer rights you have where you live.
11. Apple and Google
This section applies to the App Store version. These terms are between you and us, not Apple. Apple is not responsible for Fishburg or its content, and has no obligation to provide support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. For the Google Play version, too, these terms are between you and us, and Google is not responsible for Fishburg or its content.
12. Governing law and disputes
These terms are governed by the laws of the Republic of Turkey, and the courts of Turkey have jurisdiction over disputes. This does not take away the protection of mandatory consumer laws of the country where you live. If you are a consumer, you can also bring a claim in the courts of your home country, and in Turkey you can apply to consumer arbitration committees (tüketici hakem heyetleri) or consumer courts where the law allows.
13. Changes to these terms
We may update these terms. We will change the "Last updated" date and, for important changes, mention them in the app's update notes. If you keep playing after a change, the new terms apply.
